Calls handled in connection with Collect Nova collections activity may be recorded. Those recordings may be stored and, when Collect Nova authorizes visibility, made available in Collect Nova Portal to the assigned Client company and to Collect Nova personnel.
Call recordings may contain confidential business information and personal information. Access is limited to authorized users. Playback is streamed through a short-lived, authenticated link. Recordings are not offered as public downloads.
1. Legal duty to obtain consent and give notice
Federal law in the United States generally permits recording of a call if at least one party to the call consents (18 U.S.C. § 2511 and related authorities). Many states require all-party consent, a specific announcement, or both. Those jurisdictions have included, among others, California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington. This list is not exhaustive, is not legal advice, and changes. Other countries impose their own notice, consent, and retention rules.
Collect Nova and each Client must ensure that every recorded call complies with the law of every jurisdiction that may apply—including the location of each participant, the location of the recording system, and the location of the account. Where an announcement is required or used, it must be given at the start of the call in a clear manner.
2. Representations
By using the Portal or instructing Collect Nova to place or record calls, you represent that:
(a) recording is lawful for the relevant calls, or a valid exception applies;
(b) any required consent has been obtained and documented, and any required beep or verbal notice has been delivered;
(c) you will not use a recording for a purpose that the parties were not notified of, or that law forbids;
(d) you will promptly tell Collect Nova if a recording should not have been made or should not be visible to the Client.
3. Confidentiality and permitted use
Recordings may be used only to review collections activity performed for the assigned Client, to supervise quality, to resolve account questions, and to meet legal or audit obligations. They may not be posted, broadcast, sold, or used for marketing, employment screening, or any discriminatory or harassing purpose.
4. Access controls
Client users see only recordings assigned to their organization, marked visible to the Client, and not archived. Hidden recordings, unassigned recordings, and Collect Nova internal notes are not available to Client users. Attempting to access another company’s recording, including by changing an identifier, is forbidden and is logged.
5. Retention and withdrawal
Collect Nova may retain, archive, or withdraw a recording as required by law, the Client engagement, or risk. If a recording is subject to a legal hold, it will be preserved as required. Requests to delete or restrict a recording should be sent to legal@collectnova.test and will be evaluated under the Privacy Policy and applicable law.
6. Workplace and employee calls
If Collect Nova or a Client records calls involving their own employees, additional workplace-notice or consent rules may apply. Each employer is responsible for informing its personnel as required by law and policy.
7. Third parties on the call
If a third party joins a call, additional consent or notice may be required. Users must not play a recording in the presence of unauthorized persons.
8. No legal advice
This notice describes how the Portal treats recordings. It does not tell you whether a particular call may be recorded. Counsel for Collect Nova and for each Client must determine required notices, scripts, and consent capture for their campaigns and jurisdictions. See also the Compliance statement and Privacy Policy.
