Collect Nova Portal is designed so that a collections agency can give each Client a controlled view of calls placed on that Client’s behalf. Compliance with collections, communications, privacy, and recording law remains a legal obligation of Collect Nova and of each Client for their own conduct. This page describes the compliance framework the product is built to support. It is not a certification, license, or legal opinion.
1. Collections and consumer-protection laws
The Fair Debt Collection Practices Act (FDCPA) and CFPB Regulation F apply to many third-party collectors of consumer debt in the United States. They restrict harassment, false or misleading representations, unfair practices, and certain communications, and they impose disclosure and time-and-place rules. State collection-agency licensing, bond, and unfair-and-deceptive-acts statutes may apply even when a matter is commercial or B2B.
The Portal software does not place calls, send collection notices, or process payments. Collect Nova personnel may place authorized calls through a configured telephony provider as part of the managed service. The Portal does not determine whether a particular communication was lawful. Users must not use recordings or messages to violate FDCPA, Regulation F, state licensing rules, or comparable laws in other countries. “B2B only” is an operational scope, not a universal legal exemption.
2. Telephone Consumer Protection Act and related rules
The TCPA, FCC rules, and state telemarketing laws regulate autodialed, prerecorded, and certain marketing or collection calls and texts, especially to mobile numbers. Consent and calling-time restrictions may apply. Recording a call is a separate legal question from whether the call itself may be placed. Collect Nova and each Client are responsible for lawful calling practices. The Portal only stores and displays authorized recordings and metadata.
3. Call recording and electronic communications privacy
Recording and intercept laws include the federal Wiretap Act and state all-party consent statutes. See the Call Recording Notice. Users must not import, request, or retain a recording that was made unlawfully.
4. Credit reporting and GLBA
If Collect Nova or a Client furnishes information to consumer reporting agencies, the Fair Credit Reporting Act and related duties apply. If either party is a financial institution under the Gramm-Leach-Bliley Act, GLBA privacy and safeguards rules may apply to nonpublic personal information. The Portal is configured for confidential business access; it does not replace a GLBA information-security program.
5. Data protection and breach notification
U.S. state privacy laws, GDPR/UK GDPR where applicable, and state data-breach notification statutes may apply to personal information in recordings and accounts. Collect Nova’s practices are described in the Privacy Policy. Security incidents should be reported immediately to legal@collectnova.test.
6. Product controls that support compliance
The Portal enforces organization-scoped access; hides recordings unless marked visible to the Client; excludes internal notes from Client views; streams audio through authenticated, time-limited URLs; rate-limits playback; and writes audit events for sign-in, playback, assignment, visibility, and messaging. These controls support least-privilege access and accountability. They do not guarantee that a given call was lawfully recorded.
7. Client responsibilities
Each Client remains responsible for:
authorizing only appropriate employees to use the Portal;
using recordings solely for the engagement and in accordance with law;
its own privacy notices to its customers or account parties, where required;
any downstream sharing inside the Client organization;
promptly requesting that an unlawful or sensitive recording be hidden or withdrawn.
8. Collect Nova responsibilities
Collect Nova is responsible for operating the Portal with the access and security measures described, for assigning recordings to the correct Client organization, and for its own collections and calling compliance. Super administrators must not disable safeguards except as permitted by a written security exception.
9. Accessibility
Collect Nova intends the Portal to be usable with keyboard navigation, visible focus, and sufficient contrast. Accessibility improvements are ongoing. Contact legal@collectnova.test to request an accommodation.
10. International use
If the Portal is used from or about persons outside the United States, additional rules may apply, including local recording consent, data-localization, and cross-border transfer requirements. Do not use the Portal in a country or for a purpose that is prohibited by export, sanctions, or local law.
11. Agency licensing and bonding
Many U.S. states require a collections agency to be licensed, bonded, or registered before collecting consumer debt, and some regulate commercial collections. Collect Nova is responsible for maintaining any licenses required for its own collection activity. The Portal is not a substitute for a license, and access to recordings does not authorize a Client to collect in a jurisdiction where the Client is not permitted to do so.
12. Electronic communications
Transactional emails related to sign-in, password reset, and security are sent as needed to operate the Portal. They are not marketing. If Collect Nova later sends optional product notices, you may unsubscribe where the law requires. Users must not use the Communications area to send unlawful collection notices or unsolicited commercial messages.
13. Sanctions and restricted parties
Collect Nova will not knowingly provide Portal access in violation of U.S. sanctions or to restricted parties. Users must not upload or request processing of data that would cause Collect Nova to violate those laws.
14. Legal holds and evidence
Recordings and messages may be preserved when Collect Nova reasonably believes a legal hold, investigation, or dispute requires it. Users must not alter or destroy Portal records they know are subject to a hold. The Portal is not a court-filing system.
15. No warranty of legal compliance
Collect Nova does not warrant that use of the Portal, or any particular recording, is lawful in your circumstances. Counsel must review calling scripts, consent language, retention schedules, and Client contracts before production use.
